Nelson Mullins – FTC Advertising Compliance for Foreign Manufacturers Entering the U.S. Market


While your company is preparing to enter the United States market, it is necessary to understand and comply with advertising regulations and features of the Federal Trade Committee (FTC). These rules are designed to protect consumers from deceptive marketing and ensure fair competition. For foreign manufacturers, compliance is not optional and violations can lead to major penalties.

FTC requires all ads:

  • Sincere, not misleading
  • Mawla (i.e., you must support the pro -evidence)
  • Fine, especially in advertising claims or comparative performance

This applies to all marketing materials, including websites, packaging, brochures and digital ads.

If your company plan to indicate the origin of your products (for example, “made in Germany”), you must:

  • Exposing clearly and accurately to the country of origin
  • Avoid our origins unless the product does not fulfill strict FTC standards

The base of the signs in the United States of America is prohibited in the United States of America, “Made in Usa”, unless the “All or almost everything” product in the United States of imported products, and US border protection and US border protection (CBP) also requires a sign of the country of origin.

If your products are marketed with performance demands (for example, “3X lasts longer” or “reduces vibration”), FTC requires:

  • Specialized and reliable evidence, which may include scientific tests or standard standards for industry
  • Disclosure of disclosure if the results differ by using a case or material

If you use approvals (for example, from American distributors or industrial customers), make sure:

  • Real supporters and typical experiences
  • Any material connection is detected (for example, payment or free products)

FTC has risen to implement implementation in recent years, including foreign companies. Violations can lead to:

  • Civil penalties
  • Orders
  • Reputation damage to the United States market

  • Review all marketing materials to comply with FTC standards
  • Avoid
  • Make sure to prove all performance claims
  • Consult the US lawyer before the launch of advertising campaigns
